Terms of Service

These Terms of Service (“Terms”) govern your use of TabCast — the TabCast browser extension, the TabCast Discord bot, and the TabCast website (together, the “Service”). By installing the extension, adding the bot to a Discord server, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

In short: TabCast lets you stream a browser tab’s audio into a Discord voice channel. You’re responsible for what you choose to stream and for following Discord’s rules and applicable law. The Service is provided “as is,” and you can stop using it at any time.

1. The Service

TabCast captures the audio of a browser tab you choose and relays it in real time to a Discord voice channel in a server you’ve linked. Features may include song requests, queues, volume control, and paid “Pro” capabilities. We may add, change, or remove features at any time.

2. Eligibility

You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is greater. By using the Service you represent that you meet this requirement and that you have permission to add the bot to, and operate it within, any Discord server where you use it.

You are solely responsible for the content you stream and how you use the Service. You agree not to use TabCast to:

4. Discord

TabCast operates on top of Discord and depends on Discord’s platform and APIs. Your use of Discord is governed by Discord’s own terms and policies. TabCast is an independent product and is not affiliated with, endorsed by, or sponsored by Discord Inc. “Discord” is a trademark of Discord Inc.

We work to keep the Service running, but we do not guarantee it will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, TabCast and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50.

9. Indemnification

You agree to indemnify and hold harmless TabCast and its operators from any claims, damages, or expenses arising from the content you stream or your violation of these Terms or the rights of any third party.

10. Termination

You may stop using the Service at any time by removing the extension and the bot from your server. We may suspend or terminate your access if you violate these Terms or use the Service in a way that may cause harm or legal liability.

11. Changes to These Terms

We may update these Terms as the Service evolves. Material changes will be reflected by the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where TabCast’s operator is established, without regard to its conflict-of-laws rules. Any disputes will be handled in the courts of that jurisdiction.
